DUI Defense and Driver's License Suspension in Alabama

If you are stopped for a DUI, we strongly recommend that you refuse to take any sobriety test — such as following a light with your eyes or walking a straight line — including a Breathalyzer test. Don't count. Don't say your ABCs. Without these tests on the record, you have a much better chance to fight DUI charges.

You are under no legal obligation to take such tests, according to Alabama state law, although if you do refuse you will lose your license for 90 days under Alabama's Implied Consent Law. Even if you agree to take the test, you will lose your license if you are convicted. Still, faced with the possibility of a DUI conviction, you are better off losing your license for three months. A fourth DUI in five years is a felony in Alabama.

If you do take a field sobriety test and are arrested for DUI, you will need to file for an administrative hearing within ten days of your arrest if you want to prevent your license suspension. If you refuse, as we recommend, you will want to see a lawyer right away so you can request an administrative hearing about the loss of your license.
